These Terms & Conditions ("Terms") govern your use of the Brain & Byte website (https://brainandbyte.com) and any services offered by Brain & Byte ("we", "our", or "us").

Our Services

We offer:

  • Human-driven, AI-enabled web application development
  • Rapid prototyping and digital consulting

We may offer additional tools or software via paid subscriptions in the future.

Initial Engagement

  • The first 30-minute consultation is provided at no cost.
  • A 1-hour prototyping session is included in the agreed project scope.
  • All pricing is determined after the consultation and is billed on a project basis.
  • Each project includes 2 rounds of iteration based on feedback.

Ownership & Intellectual Property

  • Clients retain ownership of the delivered codebase.
  • Brain & Byte retains intellectual property rights to the frameworks, methods, and non-client-specific logic used in our solutions.
  • We may reuse or resell elements of solutions unless explicitly agreed otherwise.
  • Exclusive or joint-venture agreements may be arranged with tailored terms including non-compete or revenue sharing clauses.

Refund Policy

We do not offer refunds once a project has commenced or been delivered.

Limitation of Liability

To the fullest extent permitted by law, Brain & Byte is not liable for any indirect, incidental, or consequential damages arising from your use of our services or website.

Jurisdiction

These Terms are governed by the laws of Ontario, Canada. Any disputes will be resolved in accordance with those laws.
